      Metodología

        Los datos de tenencia forestal de RRI hacen un seguimiento de la superficie forestal en cuatro categorías de tenencia que estan basadas en los titulares de derechos y la solidez del acceso a estos derechos en virtud de la legislación nacional. Estos datos vinculan resultados cuantitativos y cualitativos que fueron obtenidos empleando un enfoque de Conjunto de Derechos.

        Datos sobre la tenencia forestal

        Los datos de 58 países que abarcan casi el 92 % de los bosques del mundo muestran que los derechos legales de las comunidades a poseer y gestionar los bosques aumentaron entre 2002 y 2017De acuerdo a estas cifras, la mayoría de estos avances se produjeron en 33 países de ingresos bajos y medios de África, Asia y América Latina. Sin embargo, siguen existiendo importantes problemas de aplicación y las comunidades continúan disputándose las tierras controladas por los gobiernos y otros actores. 

        Situación de los derechos de las comunidades y las mujeres de las comunidades

        Un análisis más profundo de los marcos legales que regulan la tenencia forestal comunitaria en 35 países muestra que, a pesar de la continua ampliación de las protecciones para los Pueblos Indígenas, Pueblos Afrodescendientes, comunidades locales, y mujeres dentro de estos grupos en virtud del derecho internacional, las reformas a los marcos legales nacionales han tenido un impacto desigual en los derechos de tenencia forestal comunitaria. En particular, los Estados siguen sin cumplir sus obligaciones legales de proteger los derechos de tenencia forestal comunitaria de las mujeres bajo su legislación nacional.

        En los 104 marcos legales analizados dentro de 35 países, que en conjunto abarcan alrededor del 80 % de los bosques de África, Asia y América Latina, el reconocimiento específico de los derechos de tenencia forestal comunitaria de las mujeres solo mejoró marginalmente entre 2016 y 2024.

        Los datos de tenencia forestal de RRI se publicaron por última vez en «Descargar Ante Una Encrucijada: Tendencias Significativas en el Reconocimiento de la Tenencia Forestal Comunitaria de 2002 a 2017Los datos analizan la distribución de la tenencia forestal en 58 países, que acumulan casi el 92 por ciento de la superficie forestal mundial. De los 58 países analizados, 48 son países de renta baja y media y 10 son países de renta alta.

        La metodología que subyace a estos datos se basa en el enfoque del Conjunto de Derechos para los regímenes de tenencia comunitaria (CBTR, por sus siglas en inglés).

        Un CBTR es un conjunto distinguible de leyes, reglamentos y jurisprudencia nacionales que rigen todas las situaciones en las que el derecho a poseer o gestionar los recursos naturales terrestres se tiene a nivel comunitario.

        Los CBTR se pueden clasificar como «administrados por el gobierno»; «designados para los Pueblos Indígenas, Pueblos Afrodescendientes y comunidades locales»; o «propiedad de los Pueblos Indígenas, Pueblos Afrodescendientes y comunidades locales» en función de la combinación de derechos reconocidos en las leyes nacionales, reglamentos o decisiones del tribunal supremo o constitucional de un país.

        Estos análisis se basan en los informes de 2025 «Sembrando Reformas: Obligaciones internacionales y situación de los derechos de tenencia forestal de los Pueblos Indígenas, los Pueblos Afrodescendientes y las comunidades locales en la legislación nacional» y «Resiliencia y resistencia: Derechos de las Mujeres Indígenas, Afrodescendientes y de comunidades locales a los bosques comunitarios bajo la legislación nacional».

        Estos informes se basan en el exhaustivo seguimiento que RRI ha realizado durante más de una década del conjunto de derechos de tenencia comunitarios en países clave del Sur Global con bosques. Los análisis ofrecen una evaluación crítica de la situación de los derechos de tenencia forestal de los Pueblos Indígenas, los Pueblos Afrodescendientes, las comunidades locales y las mujeres dentro de estos grupos, y examinan en qué medida se reconocen los derechos colectivos de tenencia forestal en los marcos legales nacionales a fecha de diciembre de 2024.

        Los análisis evalúan 104 marcos legales (o Régimen de tenencia comunitaria, CBTR por sus siglas en inglés) en 35 países de África, Asia y América Latina. En conjunto, estos países cubren el 80 % de la superficie forestal total de África, Asia y América Latina, y el 42 % del área forestal mundial.

        El CBTR sustenta todas las metodologías de seguimiento de la tenencia de RRI y las bases de datos asociadas. Un CBTR es un conjunto diferenciable de leyes y reglamentos nacionales, promulgados por el Estado, que rigen "todas las situaciones en las que el derecho a poseer o gestionar los recursos naturales terrestres se tiene a nivel comunitario".

        La metodología de Profundidad de los Derechos emplea un enfoque basado en un “conjunto de derechos” para evaluar los derechos colectivos de las comunidades en materia del acceso, la extracción, la gestión, la exclusión, el debido proceso y la compensación, así como la duración de estos derechos y la autoridad reconocida de las comunidades para enajenar sus derechos bajo distintos marcos legales que reconocen los derechos de tenencia forestal comunitarios. RRI también evalúa dos indicadores contextuales que aportan matices a estos derechos: 1) el Consentimiento libre, previo e informado (CLPI), y 2) el derecho a utilizar recursos o áreas para fines culturales o religiosos.

        La solidez de los CBTR se clasifica como «propiedad de los Pueblos Indígenas, los Pueblos Afrodescendientes, las comunidades locales», «designado a los Pueblos Indígenas, los Pueblos Afrodescendientes, las comunidades locales» o «administrada por el gobierno», en función de la combinación de derechos reconocidos en las leyes y reglamentos nacionales de un país o en las decisiones de los tribunales supremos o constitucionales.

        RRI’s Depth of Rights analysis assesses the status and strength of Indigenous Peoples’, Afro-descendant Peoples’, and local communities’ statutory forest tenure rights across 35 countries in Africa, Asia, and Latin America.
